 PRIVACY POLICY

I. General Provisions

  1. The controller of personal data pursuant to Article 4, point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is European Wonder Plants Kft., with its registered office at Kálvária utca 1-3., 9024 Györ, Hungary, Company Registration Number: 08 09 038304, VAT Number: HU32969414 (hereinafter: the "Controller").

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  4. The Controller has not appointed a Data Protection Officer (DPO).

II. Sources and Categories of Processed Personal Data

  1. The Controller processes personal data provided by you or personal data obtained by the Controller on the basis of the execution of your order.
  2. The Controller processes your identification and contact data and the data necessary for the performance of the contract.

III. Legal Grounds and Purpose of Processing Personal Data

  1. The legal grounds for processing personal data are:
    • Performance of a contract between you and the Controller pursuant to Article 6(1)(b) of the GDPR;
    • The legitimate interest of the Controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR;
    • Your consent to processing for direct marketing purposes (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Act XLVIII of 2008 on the basic requirements and certain restrictions of commercial advertising, in cases where no order for goods or services has taken place.
  2. The purpose of processing personal data is:
    • Processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller; personal data necessary for the successful processing of the order are required (name, address, contact details); the provision of personal data is a necessary requirement for the conclusion and performance of the contract, and without it, the contract cannot be concluded or performed by the Controller;
    • Sending commercial communications and conducting other marketing activities.
  3. There is no automated individual decision-making by the Controller within the meaning of Article 22 of the GDPR.

IV. Data Retention Period

  1. The Controller stores personal data:
    • For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims from these contractual relationships (for a period of 5 years from the termination of the contractual relationship, or for a period of 8 years if required by applicable accounting and tax regulations of Hungary). 
    • Until the consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 5 years from its granting, if personal data are processed on the basis of consent.
  2. After the retention period expires, the Controller shall delete the personal data.

V. Recipients of Personal Data (Subcontractors of the Controller)

  1. Recipients of personal data are persons:
    • Involved in the delivery of goods/services/realization of payments based on the contract,
    • Providing e-shop operation services and other services in connection with the operation of the e-shop,
    • Providing marketing services.
  2. The Controller does not intend to transfer personal data to a third country (outside the EU) or an international organization.

VI. Your Rights

  1. Under the conditions set out in the GDPR, you have:
    • The right of access to your personal data pursuant to Article 15 of the GDPR;
    • The right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR;
    • The right to erasure of personal data pursuant to Article 17 of the GDPR;
    • The right to object to processing pursuant to Article 21 of the GDPR;
    • The right to data portability pursuant to Article 20 of the GDPR;
    • The right to withdraw consent to processing in writing or electronically to the address or email of the Controller specified in Article I of these terms.
  2. Furthermore, you have the right to lodge a complaint with the national supervisory authority in case you believe that your right to data protection has been violated. In Hungary, the competent authority is:
    • NAIH (Nemzeti Adatvédelmi és Információszabadság Hatóság – National Authority for Data Protection and Freedom of Information, Address: 1055 Budapest, Falk Miksa utca 9-11., Email: ugyfelszolgalat@naih.hu).

VII. Data Security Conditions

  1. The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
  2. The Controller has taken technical measures to secure data storage and paper-based personal data storage, in particular passwords, encryption, and backups.
  3. The Controller declares that only persons authorized by them have access to personal data.

VIII. Final Provisions

  1. By submitting an order from the online order form, you confirm that you are familiar with these privacy policy terms and you completely accept them. 
  2. Any consent to the sending of commercial communications and newsletters is entirely voluntary and is granted by separately checking the relevant box in the order form, independently of the conclusion of the purchase contract. You may withdraw this consent at any time. 
  3. The Controller is entitled to unilaterally amend these terms. The current valid version of the privacy policy will always be published on the e-shop's website.

These conditions enter into force on 17. 8. 2026.
